Accept previous offer before Estate Agents - termination fee

Long story short - we made an offer on our next door neighbours property that was going through probate 2 years ago (Nov 2021 - 200K)

Beneficiaries weren't interested because it wasn't enough (even though it equalled probate value)

They have now inherited and put it on the market with an EA 4 months ago for more than we offered and already reduced once but still not back to 200k.

There's reasons why we believe it's only worth what it was originally valued at and probably won't sell for what the EA has told them.

If we managed to agree a sale with them, could they be liable for EA termination costs or could they argue it was an offer before the EA was involved therefore no termination fee - or does it all depend on their contract with the EA?

I don't particularly care either way since, as buyer, I'm not paying the EA but it could help them avoid that additional cost
